1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of the Heartitly mobile application (the “App”) operated by Heartitly (“we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Heartitly is a blood pressure recording application available for iOS and Android. The App allows you to:

  • Record blood pressure readings that you enter manually
  • View statistics and trends based on your recorded readings
  • Share your readings with family members
  • Sync readings with Apple Health (HealthKit) and Google Health Connect
  • Export your data as PDF reports

The App records blood pressure values that you enter. It does NOT measure blood pressure using your device's sensors and is NOT a medical device. The App is available in 12 languages.

Heartitly offers a free tier with basic features and an optional paid subscription (“Heartitly Pro”) that unlocks additional features such as advanced statistics, custom date ranges, and weekly summaries.

3. User Accounts

Creating an account requires a valid email address, or you can sign in with Google or Apple. When you create an account, you agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure and confidential
  • Notify us immediately if you suspect unauthorized access to your account
  • Use only one account per person

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree NOT to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to other users' data or accounts
  • Interfere with or disrupt the App's infrastructure or services
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems (bots, scrapers, or similar) to access the App
  • Impersonate another person or entity
  • Upload or transmit malicious code or content

5. Health Data and Medical Disclaimer

This section is important. Please read it carefully.

  • The App records blood pressure values that you enter manually. It does NOT measure blood pressure using your device's sensors.
  • The App is NOT a medical device and is not approved by the FDA, CE, or any other regulatory body.
  • Blood pressure categories displayed in the App (Normal, Elevated, Stage 1 Hypertension, Stage 2 Hypertension) are based on guidelines from the American Heart Association (AHA) and the European Society of Hypertension (ESH) and are for informational purposes only.
  • The App does NOT provide medical advice, diagnosis, or treatment recommendations.
  • Always consult a qualified healthcare professional for medical advice regarding your blood pressure or any health condition.
  • In case of a medical emergency, contact your local emergency services immediately.

6. Family Sharing

  • You may choose to share your blood pressure readings with other users by generating an invite code.
  • Shared access is strictly read-only. Viewers cannot modify or delete your data.
  • You are responsible for managing who has access to your data and may revoke access at any time.

7. Intellectual Property

The App, including its design, source code, graphics, user interface, and all related content, is owned by Heartitly and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of all health data you enter into the App. We claim no ownership over your personal data.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Account Termination

  • You may delete your account at any time from the Profile settings within the App. Account deletion is permanent and irreversible.
  • We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.
  • Upon termination, your data will be handled in accordance with our Privacy Policy.

10. Subscriptions and Payments

Heartitly Pro is available as a monthly or annual subscription, managed through the Apple App Store or Google Play Store.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Payment is charged to your App Store or Play Store account at confirmation of purchase
  • You can manage or cancel your subscription in your device's subscription settings
  • Refunds are handled by Apple or Google according to their respective refund policies
  • Free trial eligibility is determined by the App Store or Play Store

11. Data Backups and Recovery

We maintain backup copies of account data only for Heartitly Pro subscribers. In the event of data loss or a technical issue, we may be able to help Pro users restore their readings from our backups.

  • Free users: we do NOT maintain backups of your data. If data is lost for any reason, we will not be able to restore it. We strongly encourage free users to periodically export their readings as PDF and save the file somewhere safe.
  • Pro users: we keep backups of your account and readings. We may be able to help you restore data in case of accidental loss, though we cannot guarantee successful recovery in every situation.
  • Deleted readings: when you delete a reading or your account, the data is permanently removed. We do NOT keep copies of records you have deleted yourself, and we cannot restore them.

Regardless of subscription tier, you are responsible for maintaining your own copies of important health data. The App's PDF export feature is available to all users for this purpose.

12. Service Availability and Discontinuation

We reserve the right to modify, suspend, or discontinue the App (in whole or in part) at any time, for any reason.

  • If we decide to permanently shut down the App, we will notify users in advance via email and/or in-app notifications, giving you reasonable time to export your data before the service ends.
  • We are not liable for any inconvenience, loss, or damages resulting from modification, suspension, or discontinuation of the App.
  • In the event of service discontinuation, you remain responsible for exporting and backing up your own data before the announced shutdown date.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The App is provided “as is” and “as available” without warranties of any kind, whether express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any health outcomes, medical decisions, or consequences resulting from your use of the App.
  • We are not liable for loss of data, including data lost due to deletion, account termination, technical failures, or service discontinuation.
  • Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by updating the “Last updated” date at the top of this page.
